Property and leasing consultation checklist

The solicitor should receive the complete contract or lease package before the client signs, together with finance, timing and disclosure information.

Property sale or purchase

  • Provide the complete contract of sale, disclosure documents, title material and annexures.
  • For Victorian residential property, include the Section 32 statement; for NSW property, include the complete contract and prescribed attachments.
  • Provide finance status, deposit arrangements, required settlement date and proposed special conditions.
  • For strata or owners corporation property, include available certificates, levies, minutes, budgets and known building issues.

Commercial or retail leasing

  • Provide the proposed or signed lease, disclosure statement, incentive deed, guarantee and all amendments.
  • Identify the permitted use, lease term, options, rent, review method, outgoings and security.
  • Provide fit-out plans, landlord works, make-good obligations, trading requirements and insurance conditions.
  • Record representations made by the landlord or agent and any known disruption, development or access issue.

Disputes and existing leases

  • Bring the signed lease, disclosure documents, correspondence and every notice of breach, rent review, termination or option.
  • Prepare a rent and outgoings history, repair chronology and photographs or expert material.
  • Identify mediation, VCAT, NCAT or court documents and current deadlines.

Before the appointment

Keep original documents safe, preserve electronic records and bring a short list of the questions and outcomes you want to discuss. Tell the solicitor about urgent deadlines at the beginning of the conference.
